We operate an online vehicle advertising platform promoting new cars, vans and motorcycles on behalf of authorised UK motor dealers ("Dealers").

We are not a motor dealer and do not sell vehicles directly to consumers.

2. Our Role

2.1 We act solely as an advertising intermediary between users and Dealers.

2.2 Any contract for the purchase, financing, or leasing of a vehicle is entered into directly between you and the relevant Dealer.

2.3 We:

• Do not own the vehicles listed

• Do not inspect or test vehicles

• Do not control Dealer pricing

• Do not negotiate sales on behalf of Dealers

• Are not a party to any vehicle sale agreement

2.4 Responsibility for vehicle descriptions, pricing, availability and compliance with UK consumer law rests solely with the Dealer.

3. Vehicle Listings and Accuracy

3.1 Vehicle information, images, specifications and finance examples are supplied by Dealers.

3.2 Whilst we take reasonable care in presenting information clearly, we do not warrant that:

• Listings are accurate or complete

• Vehicles remain available

• Prices are free from typographical or technical errors

3.3 Dealers are responsible for complying with all applicable UK consumer protection legislation.

3.4 In the event of pricing errors, Dealers reserve the right not to proceed with a transaction.

4. Consumer Rights

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable UK consumer legislation.

Your legal rights in relation to any vehicle purchase are against the selling Dealer, not Cromwell & Mason Ltd.

5. Finance Information Disclaimer

5.1 Any finance examples shown are illustrative only and do not constitute an offer of credit.

5.2 Finance is subject to:

• Status

• Credit approval

• Affordability checks

• Terms and conditions of the relevant finance provider

5.3 Cromwell & Mason Ltd is not a credit broker unless expressly stated on the Website. If we become authorised and regulated by the Financial Conduct Authority (FCA), appropriate disclosures will be displayed.

6. Use of the Website

You agree that you will not:

9. Limitation of Liability

Subject to the above, Cromwell & Mason Ltd shall not be liable for:

• Indirect or consequential loss

• Disputes between users and Dealers

To the extent permitted by law, our total liability in connection with use of the Website shall not exceed £100.

10. Website Availability

We do not guarantee uninterrupted or error-free access to the Website.

We may:

• Suspend access for maintenance

• Modify or withdraw services

• Remove listings at our discretion

11. Privacy and Data Protection

We process personal data in accordance with the UK GDPR and the Data Protection Act 2018.

When you submit an enquiry, your details may be passed directly to the relevant Dealer so they can contact you regarding your enquiry.
